What is personal data and what does the handling of it mean?
Personal data is any kind of information referable to a living, physical person. It can be a name, a social security number or a phone number. All handling of personal data given to Wesslau Söderqvist Advokatbyrå is done for us to fulfil our obligations to you as a client. It is also carried out for us to observe the rules of the Swedish Bar Association, and other relevant set of regulations applicable to our operation.
Your personal data will also be administered by our contractors as they perform work that includes handling of personal data. We have, for instance, contractors engaged to perform services and operations in regards to the supplying of IT-systems. All contractors handling personal data on our behalf is working under our Personal Data Processing Agreement to ensure that your personal data is handled in accordance with current regulations. As a main principle, the law firm is always responsible for the personal data that is being handled.

Why WSA handles personal data
Wesslau Söderqvist Advokatbyrå receives your personal data as you sign a service contract with us or when you leave us your personal data in exchange for marketing material such as newsletters.
Wesslau Söderqvist Advokatbyrå also receives personal data in connection with recruiting or contract procedures where personal contact information is specified.
Wesslau Söderqvist Advokatbyrå handles personal data to fulfil the client agreements concluded by us. Personal data is also handled to observe general regulations for companies such as accounting rules, and regulations specific to the operation of a law firm, such as rules on money laundering. The right to handle personal data is based on the agreement between the registered part and Wesslau Söderqvist Advokatbyrå, on legal obligations, or on the consent of the registered party. Wesslau Söderqvist Advokatbyrå can also handle personal data as a ground for marketing initiatives such as invitations to seminars or other events. The right to handle your personal data for marketing purposes is based on a levelling of interest by Wesslau Söderqvist Advokatbyrå before handling your personal data.

How your personal data is processed in the event of bankruptcy
At Wesslau Söderqvist Advokatbyrå, we have lawyers who undertake work as court appointed trustees in bankruptcy. Wesslau Söderqvist Law Firm therefore needs to process certain personal data, in order to carry out effective bankruptcy management.
Two different controllers
In the event of bankruptcy, a separate legal person arises, the bankruptcy estate, represented by a trustee. The bankruptcy estate is the data controller for the processing that takes place within the framework of the bankruptcy estate’s operations, i.e., the bankruptcy estate is responsible for ensuring that such processing takes place in accordance with the applicable data protection regulations. For the processing of personal data that is also carried out within the framework of the law firm’s normal operations, Wesslau Söderqvist Advokatbyrå is the data controller.
What personal data is processed?
When handling a bankruptcy, the bankruptcy estate handles the necessary personal data such as name and social security number, contact details, property designation, vehicle registration number, IP number, bank details and work-related personal data such as salary, trade union affiliation and health.
Purpose and legal basis
The specific purposes for the processing of personal data in bankruptcy are to enter into, manage and fulfil contracts, fulfil accounting obligations, constitute bankruptcy estate inventory and administrator’s report, decide on a wage guarantee, to ensure that creditors are not disadvantaged and to comply with the other obligations of the insolvency administrator by law.
Wesslau Söderqvist Advokatbyrå and the bankruptcy estate process personal data in bankruptcy with legal basis in execution of contracts, a balance of interests for the handling of relevant business documents, legal obligation for the many obligations incumbent on the receiver by law and in the performance of tasks of general interest/authority exercise in, for example, decisions on wage guarantees. The sensitive personal data processed by Wesslau Söderqvist Advokatbyrå and/or the bankruptcy estate in bankruptcy proceedings is made based on labor law obligations or to establish, enforce or defend legal claims.
Personal categories
The bankruptcy estate and Wesslau Söderqvist Advokatbyrås process personal data by, among others, deputies of the bankruptcy company, bankruptcy debtors, representatives of creditors, debtors, shareholders, employees, guarantors, customers, suppliers, auditors and accounting consultants, the state, banks, third parties and family members.
Privacy and storage
The Bankruptcy Estate and Wesslau Söderqvist Advokatbyrå handle the personal data included in the bankruptcy with appropriate confidentiality. Personal data linked to the bankruptcy may be disclosed to other actors in the handling of the bankruptcy. These may include group companies, service providers and other consultants or authorities. In some cases, third parties may become independently responsible for personal data, jointly responsible for personal data with the bankruptcy estate or the bankruptcy estate assistant.
The personal data in question is processed for as long as it is necessary for the bankruptcy administration and is normally stored for 10 years in accordance with the guidelines of the Swedish bar association, Advokatsamfundet.
Handling of personal data outside the EU/EES
We strive to handle your personal data within the EU/EES. It is however possible for the data to be handled outside of the EU/EES in some cases. In that case our personal data will be handled at an adequate level of security similar to, and at the same level as, the protection offered inside the EU/EES.
